Good luck to Martin Lewis of the Money Saving Expert site who is suing Facebook over the fake ads it allows scammers to run with his image and mocked up fake news stories. It is appalling that FB allows scammers, anti-vac ranters and crank pressure groups telling lies to run paid advertising campaigns.

Today (Monday 23 April), Martin Lewis will issue High Court proceedings against Facebook, to try and stop all the disgusting repeated fake adverts from scammers it refuses to stop publishing with his picture, name and reputation. To explain it, below is the official press release announcing his action and examples of the FAKE paid ad campaigns from which Facebook receives revenues – including click through ads and adverts using fake mocked up news stories featuring Martin Lewis’s image.

Martin Lewis to sue Facebook for defamation in groundbreaking campaigning lawsuit

Martin Lewis is the founder of the consumer help site MoneySavingExpert.com and the Money & Mental Health Policy Institute charity, as well as presenter of ITV’s The Martin Lewis Money Show.

Today, in an individual capacity, he will issue High Court proceedings for a campaigning defamation lawsuit against Facebook and will be seeking exemplary damages. This is not being done for personal gain – he pledges any and all money paid out to him will be donated to anti-scam charities.

Within the last year, the social media site has published over 50 fake Martin Lewis adverts (sample images below), which are regularly seen, likely by millions of people, in the UK. These adverts are often for scams. Many have big pictures of Martin and his name, alongside a raft of false promises or endorsements – some then link on to fake articles which continue the theme.

The most prevalent are get-rich-quick schemes currently titled ‘Bitcoin code’ or ‘Cloud Trader’, which are fronts for binary trading firms based outside the EU. Binary trading is a financially dangerous, near-certain money-loser, which the regulator the Financial Conduct Authority (FCA) strongly warns against.

Solicitor Mark Lewis from Seddons law firm is leading the case. Mark was the lawyer behind the successful Jack Monroe libel case for defamation on Twitter, and represented the Dowler family in the phone-hacking case against the News of the World.

Martin Lewis comments:

“Enough is enough. I’ve been fighting for over a year to stop Facebook letting scammers use my name and face to rip off vulnerable people – yet it continues. I feel sick each time I hear of another victim being conned because of trust they wrongly thought they were placing in me. One lady had over £100,000 taken from her.

“I don’t do adverts. I’ve told Facebook that. Any ad with my picture or name in is without my permission. I’ve asked it not to publish them, or at least to check their legitimacy with me before publishing. This shouldn’t be difficult – after all, it’s a leader in face and text recognition. Yet it simply continues to repeatedly publish these adverts and then relies on me to report them, once the damage has been done.

“Even when they are reported, many have been left up for days or weeks. And finally, when they are taken down the scammers just launch a new, nearly identical campaign very soon afterwards and the whole rigmarole starts again.

“I’m not the only public face this has happened to. It’s time Facebook was made to take responsibility. It claims to be a platform not a publisher – yet this isn’t just a post on a web forum, it is being paid to publish, promulgate and promote what are often fraudulent enterprises. My hope is this lawsuit will force it to change its system. Nothing else has worked. People need protection.

“And of course, on a personal note, as well as the huge amount of time, stress and effort it takes to continually combat these scams, this whole episode has been extremely depressing – to see my reputation besmirched by such a big company, out of an unending greed to keep raking in its ad cash.”

Mark Lewis of Seddons, the lawyer leading the team, comments:

“Facebook is not above the law – it cannot hide outside the UK and think that it is untouchable.  Exemplary damages are being sought. This means we will ask the court to ensure they are substantial enough that Facebook can’t simply see paying out damages as just the ‘cost of business’ and carry on regardless. It needs to be shown that the price of causing misery is very high.”

Mark Zuckerberg and Sheryl Sandberg should be deeply ashamed of the money they make from, frauds, counterfeiters and scammers and the false credibility they allow them to have by advertising and data targeting on Facebook.
